Docs get packed away by mistake all the time. That’s why trump was given so many chances to return what he had, before a subpoena and a raid happened.

Trump's defense ended on Jan 20th. Why is a private citizen refusing to hand off all classified documents?

My OP comment was about preventing documents from leaving the WH, so it's bipartisan...

I don't think Trump has a valid defense for what they found with the MAL search... His defense seems to be that he completely misunderstood the law, which does sometimes work.. UNTIL you refuse to give everything back when asked...

All of that classified came from the time he actually was President, so proving that it was not declassified is going to be a pretty high legal burden.

Please share. The only ones he’s state publicly were already rejected by the judge. She’s already ruled the docs are classified and don’t belong to him….what else could he have?

That the documents were declassified. Otherwise how would GSA allow them to be shipped to Florida?

Its simple. Trump was on tape bragging about how he could have declassified certain documents before leaving office.

But it doesn't matter because willful retention of government documents, whether classified OE declassified is against the law...and the law applies to everyone.

As this thread demonstrates, it does not apply to everyone!

    Willful retention. That's the difference.

Here's a question. If the law is being applied differently, why did the FBI and DOJ spend a year begging for the documents instead of executing a search warrant and then charging Trump on day 1?

Do you believe willfully obscuring government documents should have consequences?

'Conservative Legal Scholar Calls for Impeachment of Judge Cannon: ‘Member of the Trump Defense Team’

    November 18, 2023 - 8:18am

"A leading member of a conservative think tank is now calling for US District Judge Aileen Cannon — the Trump-appointed judge overseeing the former president's classified documents trial — to be impeached.

In a response to the news Thursday evening that Judge Cannon was refusing to set a key pre-trial deadline until next year, Norman Ornstein — an Emeritus scholar at the Koch-funded American Enterprise Institute — called for an impeachment resolution to be introduced against Cannon.

"She is a full fledged member of the Trump defense team. Aileen Cannon is utterly unfit for the bench," Ornstein tweeted. "[The resolution] will go nowhere but will highlight her outrageous conduct."

Special counsel Jack Smith previously asked Judge Cannon to set a Section 5 deadline under the Classified Information Procedures Act (CIPA), which would make a defendant specify which classified information they intend to use at trial. Cannon, for her part, refused to do so and said a CIPA deadline wouldn't be set until March 1, 2024. Because the trial is set for May of 2024, setting a CIPA deadline so late would almost certainly cause a significant delay in trial proceedings. The Guardian's Hugo Lowell estimated Cannon's actions would push the trial back by roughly four months.

After news broke of Cannon's refusal to set a CIPA deadline, former federal prosecutor Andrew Weissmann tweeted "Judge Cannon's bias is showing over and over again."

Because the "law" in this case only applies to the Vice President and a Senator, not to a former President who accessed classified information solely as a byproduct of being the President.

In order for the "law" to apply, you have to prove that those documents were not declassified by the President when he was the President; the sole declassification authority. All of the laws regarding the handling and retention of classified information are aimed at everyone involved who has access to classified information, except for the President.

So since this thread isn't even about a former President, it's about a current President who mishandled classified information long before he was in that role, explain why no charges were brought.

So why did it take 7 years for Biden?.... The NARA keeps the original... Trump and Vice President Biden would have copies "MARKED" classified... NARA knew from day one what documents Biden had... unless he stole them...
And remember the "find" date of November by the Biden clan is a lie.... Biden's documents were found 6 months before the election in May... where is the investigation into that..
But don't worry.... Thanks to Comer this won't be swept under the rug.... in fact it will be brought into the light for all to see.... the obstruction of justice by Biden and the blatant coverup by our corrupt DOJ...
