That is the law Trump is being charged with. It does not say the documents have to be classified in order for a crime to have been committed. Trump's legal access to those documents on a private residence without explicit permission of ther government ended on January 20.

If you see the law that I cited that Trump is being charged with, the differentiating factor is intent. Where was the intent from biden? Where did he obstruct access to documents for over a year? Do you believe that Trump still had a legal right to those documents?
