Why would a New York State agency have records for someone who was from Hawaii. HESC manages State programs he would not have been eligible for.

Actually, this does equate to a challenge to the President's Citizenship, and his eligibility to be President. The Constitution requires a candidate for the Presidency of the United States be a Natural Born Citizen. There is actually two requirements in that statement. One is Naturally born. This means born in the United States. The other is Citizen. Now, I am sure you are thinking that if you were born in the US then you automatically are a citizen of the US, and you retain that status for life. The fact is that through an overt action on your point you can give up your citizenship. The United States does not have a law in relation dual citizenship, but there is a section in the State Department Handbook that outlines the handling of dual citizenship. It states that if a US Citizen moves to another country and applies for citizenship, they retain their US Citizenship. The exception to this rule is that if the country has a Citizenship Oath that requires them to renounce any other Citizenships that they have.

Many Birthers have claimed that Obama lost his citizenship when his mother remarried, and had him enrolled in school in Indonesia. This is not true. The actions of a parent does not effect the citizenship of the child. This is as long as the Child returns to the US prior to his 18th birthday. In the Case of Obama, he returned to Hawaii at the age of 10 years old. So, the question is, how did he get financial aide reserved to foreign nationals. The answer is that under Indonesian law, a child can have dual citizenship up to his/her 18th birthday. After that they are required to take the citizenship oath, or to give up their Indonesian citizenship. To get that financial aide, Obama would have had to take the Indonesian Citizenship Oath. This would allow him to renew his Indonesian Passport, and use it to qualify for the aide. As a result, Obama committed an overt act that renounced his US Citizenship Status, and removed his eligibility for the US Presidency.

here's an example of something that didn't pan out:

 

Irrelevant of where anyone was born they could have lied or gained another countries citizenship. What- could no Republican have ever lied?

The foreign students I knew received foreign aid only from their home countries- which have been awkward for Obama since he lived in Hawaii from age 10 on, and graduated from an Hawaiian high school.

On the other hand- most of my fellow American college students did get either scholarships or student loans- those were easy to come by in those days- the American students I knew always had an easier time with money than the foreign students unless foreign daddy was rich.

Birthers of course look for whatever path that leads to "Obama not citizen"- no matter how torturous or unlikely it is.
