I just don't understand how the president can be described as an affirmative action president. His campaign was better organized and he received more votes then his Republican challenger. Maybe if more conservatives got off there butts and voted volunteered and worked harder they wouldn't be on this forum whining about our president.

There was only one point of speculation. That was the assumption of whether the Whistleblower was telling the truth. Every other point can be found online at the State Department website. Now, either prove me wrong, or move on.

Maybe Obama wasn't fully aware of his options, after having been out of the USA for years.

I can relate. I was home-schooled off the grid until I became an adult and filed at the DMV and college. Do you know I dodged a bullet? I completed my identity verifications just a few months before 9/11/2001. After that time, in the post-9/11 hysteria, new strict identity restrictions were put into place in my state, New York, that would have made it very hard to impossible for me to verify myself and enroll in college. My Social Security number and birth certificate wouldn't have been sufficient anymore and relatives could no longer vouch for me. My younger siblings, who were fortunate enough not to be old enough to need such things yet, were still blocked out by the system until a few years later when identity restrictions were lowered.

 

Okay lets review step by step- shall we?

1) So, the question is, how did he get financial aide reserved to foreign nationals.- No- that is not a question- that is speculation- since there is no evidence that any of that happened.

2) The answer is that under Indonesian law, a child can have dual citizenship up to his/her 18th birthday. After that they are required to take the citizenship oath, or to give up their Indonesian citizenship. To get that financial aide, Obama would have had to take the Indonesian Citizenship Oath. - Again- speculation- what foreign aid? This assumes some specific foreign aid that required Obama to be an Indonesian citizen- what is it- and where is the evidence that it required that he be an Indonesian citizen?

3) This would allow him to renew his Indonesian Passport,- Again speculation- there is no evidence that Obama ever had an Indonesian passport.


5) As a result, Obama committed an overt act that renounced his US Citizenship Status, and removed his eligibility for the US President- this is speculation built upon speculation.

You assume that Obama was an Indonesian citizen, you assume that he must have had an Indonesian passport- and you assume that Obama then must have renounced his U.S. citizenship- and then you assume that means that Obama automatically lost his U.S. citizenship.

Lots of assumptions and speculation.

Now to the meat of the section- how would Obama have become an Indonesian citizen? Obama was over 5 years old when he went to Indonesia,

Law No. 62 of Indonesia states:

(1)A foreign child of less than 5 years age who is adopted by a citizen of the Republic of Indonesia acquires the citizenship of the Republic of Indonesia, if such an adoption is declared legal by the Pengadilan Negeri [state court] at the residence of the person adopting the child

So that wouldn't apply.

The rather complicated Article 3 is of interest. It says that a child cannot acquire Indonesian citizenship if it would create dual citizenship unless the child is able to renounce said citizenship (which an American child is unable to do).

(1)A child outside a marriage of a mother who is a citizen of the Republic of Indonesia or a child out of a legal marriage, but who has in a case of divorce been assigned to the care of its mother, a citizen of the Republic of Indonesia, who follows the nationality of the father, a foreigner, may present a petition to the Minister of Justice in order to acquire the citizenship of the Republic of Indonesia, if, after, having acquired the citizenship of the Republic of Indonesia, it possesses no other nationality or states at the same time to have released another nationality according to the procedure stipulated by the legal provisions of the country of origin and/or according to the procedure stipulated by the agreement on the settlement of the bi-nationality between the Republic of Indonesia and the country in question

So Indonesian law prohibitted a child from becoming a dual Indonesian citizen, and American law doesn't provide for a child to renounce his citizenship.

What you are left with is the rather odd imaginary scenario whereby 18 year old Barack Obama- living in Hawaii- would have to go the Indonesian consulate in Hawaii- except there is no consulate in Hawaii.....did he go to the Consulate in Los Angeles- after starting college there?- to renounce his citizenship- and somehow the U.S. State Department never knew about this- because the U.S. State Department has already stated in a court filing that Barack Obama was never an Indonesian citizen.

So what do we have?

The State Department has said Obama was never an Indonesian citizen- that is a fact.

Everything else is speculation.

 

And why is that do you suppose?

Because the Federal courts don't operate on the whims of birther nutjobs, but according to the law.

Obama had no say in it. He was not legally competent, under US laws, to accept it.
