    Well, having to play devils advocate here, Zimmerman is technically black via the one drop rule, so he could have also been the African American male on top, Crunk may try to get Angela Corey the retard to argue that.

    I believe also that you are wrong on this point. As i understand the process, if Z wants to use self-defense under Fla SYG law, He will have the chance before the trial to plead his case to a judge. At this hearing, the judge will have the option to drop the charges, or deny the request. The burden of proof will be on Z to convince the judge that it was self defense. When and if it goes to trial, the burden shifts to the prosecution. It would be nice if some of our Florida members wouyld weigh in and help clear this issue up.

    Normally, in a self defense case, the burden of proving that it was self defense would be on the defendant, but under the Florida SYG laws, the burden is less so.

    It is quite possible that Zimmerman would be acquitted on trial, but it would just be evidence of how flimsy SYG is. You can not just go out and provoke / get into a fight, shoot the other person and then claim self defense. That's total BS.

    Having said that, SYG would be more applicable in Trayvon's case thus denying the same argument to Zimmerman. As per SYG, there is no duty to retreat from anywhere a person may legally be, therefore when Zimmerman followed and then confronted Trayvon, Trayvon had no obligation to retreat but had the right to defend himself any way he could. As the law states:
    "A person is justified in using force, except deadly force, against another when and to the extent that the person reasonably believes that such conduct is necessary to defend himself or herself or another against the other’s imminent use of unlawful force."

    As times goes by, witnesses will recall details they didn't recall before. Very common. Sorry, I know you want to disqualify all the witnesses because none of them back your desired outcome. Sorry, ain't gonna happen.

    Please explain how a neighborhood watch captain, who has already helped solve crimes in a CRIME-RIDDEN AREA, in the MIDDLE OF A WAVE OF BURGLARIES, INCLUDING AT LEAST ONE HOME INVASION, is "provoking a fight" by taking an interest in the actions of a staranger in the neighborhood, acting suspiciously,at night?

    LOL. Its never, ever, ever ever ever ever ever going to happen and the libs just cant process the thought. Seriously, as much as Obama forced this down our throats, he needs to provide therapy for the followers who aren't going to be able to handle the final ending of this case.

    Zimmerman shot to death an unarmed black kid on the walkway to his home after confronting him after racial-profiling him after the cops told 'em to cease and desist ... do some more magic-dust to see it as poor little Zimmerman ...

    The 911 police didn't even know Zimmerman was a neighborhood watchman let alone an armed one ... they thought he was 'jus nutha pain-in-the-ass civilian / resident reporting a suspicious person who would abide by a police order ...

    Do some more magic-dust to get yourself-off ...

    Calling the police about a suspicious person is not limited to just the neighborhood watch. Anyone can do it.
    And the police never ordered him not to follow. On that they "didn't need <him> to do that". Which is vastly different from "don't do that".

    The Joe Horn case, specifically the 911 call, is on a different planet than this one ... Joe Horn was told not to leave his house 14 times ... Joe Horn simply told the 911 police he was locked 'n loaded and he was gonna shoot the black dudes burglarizing the next door neighbor house ... he did ... he shot 'em to death as they were exiting ... you can even hear Joe Horn shooting-to-death the perps as they came out of the house ... seconds before the police arrived ...

    Joe Horn got away with it under the Castle Doctrine/Stand your Ground Law ...

    This was precedence ... that is, cases of precedence are used in trials and courts of law ... should be good when Zimmerman attorney O'Mara tries to slide this one in ...

    As neighborhood watch captain, his only duty was to watch and report. Nothing else. When he went out to confront Trayvon, he did so as an ordinary citizen since by doing so he was exceeding his authority as watch captain. He was a watch captain NOT a cop. there are reasons why you can't just go around playing cop.

    Second, Trayvon was not acting suspiciously. Zimmerman had no evidence to believe that Trayvon was doing anything illegal or suspicious other than the fact that Trayvon was black which would be insufficient grounds.

    In such case, it becomes irrelevant whether or not he was a watch captain. In the light of the law, he would be judged as if he were an ordinary citizen because the NW mandate expressly forbid its members from confronting or provoking situations. When he did that, he was not acting as watch captain but only as an ordinary citizen.

    Can an ordinary person pursue anyone at night, give him reason to be afraid, provoke a fight and then shoot the person claiming self defense? I would think not.

    I have wondered about this myself. How is it that Zimmerman "provoked" a fight when they both seem equally at fault in that aspect of the case. It isn't a question of who started it. At one point during the fight it turned deadly and deadly force was used.
