In Maine it does not count as statutory rape if the two are within 4 years of each other. YMMV depending on state, though.

The Romeo and Juliet laws are applied WHEN their is statutory rape, to defend the accused from severe punishment, if this was a consensual sexual relationship. this case was not in maine... in FL, where the case occurred, she broke the law. This was not even national news until the pro-gay community made it so by jumping to this predator's defense for no other reason than she said she was only being arrested because she was a lesbian....
