Well adults fooling around with minors ages 13-15 doesn't seem too bad. http://www.guttmacher.org/pubs/journals/3430402.html Think it should be a misdemeanor rather a felony, unless it's a teacher and/or they are making porn of it.
until it's YOUR 13-15 y.o. daughter a 21 y.o. is having sex with... you only say that because your daughter wasn't the one that was/is being preyed upon.
Not saying it should be legal but rather is not on the nearly as harmful as someone who fools around with kids 12 and under to be a felony. You're saying it should be a felony because its embarrassing to parents?
If a 21 year old was bullying your 13-15 year old daughter should that be a felony? That's actually worse you know.
It actually is the reason. Main reason for the existence of age of consent laws is due to power imbalance present when there is a large age disparity leading to higher risk of abuse or exploitation. Which is why sex with people their own age is often legal at any age due to close age exceptions.
I thought the main reason was to protect people who can not give meaningful consent and that power imbalances refers to where one has control over the other, such as teacher-student.
Power imbalances also refer to age difference and that is crucial for these kinds of laws and questions. Sure you will agree that sufficiently different ages are basis for a pretty strong power imbalance. The main reason is to protect kids from harm, mental or physical. What causes this harm in case of sex is being forced into sex against their will or its abusive nature, this is true for kids and adults equally. The likelihood of that happening depends on power imbalance of those involved, with age difference being very important factor, but things like teacher-student relations can also be considered.
no, I'm saying you don't consider it a big deal but if it's your 13-16 y.o. daughter being victimized, your tune would then change.
If you're referring to exploitative behavior 12 months of incarceration(usually the maximum punishment of a misdemeanor) seems like the proper punishment.
How so? There was this case where a man had sex with 14 year old who lied about her age. Was that victimization?
and that's fine... you found a loophole.... absolutely if she's deceptive... he can get off the hook. But this case in this thread, the 18 y.o. knew the 14 y.o. was a 14 y.o. if 18+ knows the age... they are victimizing the 14 y.o.
Here is another possible loophole. What if the 14 year old was begging for the sex and the older person knew about the age? Is it still felony worthy?
Just FYI, this case isn't pedophelia, its known as ****phelia, sexual attraction to pubescent children 11-14. Since this girl was 14, it's on the upper range of ****phelia, and there is nothing after that, it's considered normal to be attracted to 15yo kids as developmentally they are adults. http://en.wikipedia.org/wiki/****philia
the power difference.... - - - Updated - - - that sure is two fancy terms that both describe "sexual predator"
Sad story. Seems like a harsh law that doesn't let kids be kids, but 14 and 18 is a stretch. They should have waited 2 years.
"kids being kids" including sex mentality is what's wrong with society. very few 14 y.o.s are capable of understanding the consequences of sex... and even the ones that can, have no way of dealing with it even if they understand. 18 is not a kid, either. I know it's normal for that age to want sex... but to target a 14 y.o. is what I don't like. Guy or girl, gay or straight, that is exactly what happened.... the 18 y.o. took advantage of the naivity of a child
