    Oral Argument In CHECC v. EPA: The Issue Of Standing

    • This morning the DC Circuit Court of Appeals in Washington held oral argument in the case of the Concerned Household Electricity Consumers Council v. EPA.

    • That’s the case where a hardy band of citizen petitioners (CHECC) challenges the 2009 finding of EPA that CO2 and other “greenhouse gases” constitute a “danger” to human health and welfare by reason of their potential to warm the atmosphere.

    • That finding, known as the Endangerment Finding or EF, is the underlying basis for the all-of-government regulatory assault on the fossil fuel industry and the energy economy currently being conducted by the Biden Administration.
    • Slightly less than all of the argument was devoted to an issue that we lawyers call “standing.”

    They are disproven by research and published, peer-reviewed papers, as collected in this book. From the link:

There are fresh insights in each chapter, borne of Longhurst’s objective analysis of the data and the literature. The papers he cites are from Nature, Science, PNAS, Journal of Climate and other mainstream, high impact journals. …. However, each of these papers provides a critical link in Longhurst’s reasoning that produces conclusions that do not agree with the ‘consensus.’”

    Notice that he ignored my post #134 requesting answer to support his claim. :lol:

    It is clear he doesn't know.

    He doesn't even know what he is talking about when he makes this unsupported claim,

    "scientific theories and models are not disproven......"

    They have been refuted years ago as the growing list of evidence showing that CO2 doesn't drive weather or climate at all and that no Climate Crisis exist which he will ignore since he doesn't know.

    Oklahoma blacklists BlackRock and 12 other banks that boycott fossil fuels
    We may yet be saved by states in the US that are pulling the pin on the Big Banker Cartel. In this case Oklahoma wrote laws to investigate and ban state investments with banks that boycott the energy sector. They’ve now decided that 13 banks fail the bar, and should be banned from all public business. In response BlackRock and JPMorgan Chase are now dancing to a whole new tune, suddenly protesting that they invest billions in the energy sector. The twisted truth is, that it is no defense at all, it was part of their strategy. Often they used their major voting interest to oust directors and pressure boards to pick up more “woke” ESG policies. These are big targets. JP Morgan Chase is the largest bank in the US and BlackRock is the largest asset manager in the world.

    This is excellent news, and we need more. Spread the news. But how did it get to the point where a bank that outspokenly campaigned to end fossil fuels was managing 60% of the state employees retirement funds in a state that is the fifth or sixth biggest oil and gas state in the US? This rort meant the bank managed funds on behalf of people who spent their whole lives working in the oil and gas industry — yet it used their funds as leveraged power to try to destroy their livelihood, to make their energy costs rise and to undo their democratic choices.

    Make no mistake, the banker money isn’t following the fashions, it is creating them. The way to win is to turn off the tap…

    The EU is fracturing over energy, and not a day too soon…
    Signs of hope. Just as Germany recently pulled the pin on the EU’s Electric Vehicle mandate, France is now threatening to scupper the EU’s new Renewable Energy Directive unless they include a role for nuclear power. It was supposed to be signed off on Wednesday. Despite nuclear being the only reliable baseload source of “Net Zero” energy, France has had to fight for its inclusion at every step. . . .

    German Greens In Crisis, Plummet 40% In Opinion Polls As Anger Mounts Over Bans, Scandals

    Being the media darlings has not prevented the German Greens from collapsing in the public opinion polls. 40% of green voters have taken their approval away since it peaked in popularity at 23%.

    A series of unpopular, draconian policy proposals along with cronyism scandals have resulted in a body blow for Green Party popularity in Germany.

    Accusations of cronyism have surfaced after a top advisor of Green Economics Minister Robert Habeck awarded state contracts to family members and other close associates.

    Secretary for Climate Affairs Dr. Patrick Graichen is accused of having awarded government contracts to a research institute run by multiple members of his family. He also appointed his best man to head the German Energy Agency.

    The woes for Graichen may also be compounding as “a suspicion of violations of citation rules” regarding his doctoral thesis has surfaced.

    Today critical site Pleiteticker.de here reports “German Greens are in crisis!”

    “Thanks to the Graichen scandal and the dispute between the Socialist-Green government over the heat pump law, the party has recently plummeted in the polls to 14 percent, well behind the hard right AfD (17 percent) – ten months ago the Greens were still at 23 percent,” reports Pleiteticker. That means the party has lost 40% of its voter base.

    This is the result of the most recent INSA survey by “BILD am Sonntag”.

    “More than half of Germans (56 per cent) say Habeck is doing a bad job, only 25 per cent attest him good work – in June, 2022, 43 per cent of people still thought Habeck was a good minister. Forty-two per cent even think Habeck is damaging the reputation of the Greens, only 9 per cent think he is helping the party’s reputation,” comments Pleiteticker.

    The future for the Greens will remain bleak, with no signs of a turnaround in sight. In fact chances are better than even that things are going to get a lot worse as the bills for energy and drastic green policies start coming due.
