    Not charged? Because it's a misdemeanor and the SoL on that is like a year, not 5 years with extra time due to the pandemic and incumbency and being out of state. Not cited? Because he legally didn't have to, he says, but I'd argue he should have because of how it has confused people, poor messaging. The laws rely upon each other to be valid, but only the felonies can be charged at this point. Though for the felonies to hold, both parts will need to be proven - the election law conspiracy and the false records.

    Presumably Bragg can, as it's explicitly in his indictment:

    "19. The Defendant directed Lawyer A to delay making a payment to Woman 2 as long as possible. He instructed Lawyer A that if they could delay the payment until after the election, they could avoid paying altogether, because at that point it would not matter if the story became public. As reflected in emails and text messages between and among Lawyer A, Lawyer B, and the AMI Editor-in-Chief, Lawyer A attempted to delay making payment as long as possible."

    You're referring to election laws. I talking about campaign laws. There are no laws in New York state governing Federal campaigns.

    People pay for NDA from others routinely. Most court settlements involve NDA agreements as to the terms of them.

    Is it reasonable to assume that a person having an affair would not want their spouse or others to find out about it whether they were running for a political office or not?
