    Yes, and you can't run the check without the 4473. The 4473 is the authorization, information, and swearing of truth that allows the background check in the first place.

    They are not. By law an FFL dealer cannot sell a gun if the form has a response that bans the transaction. You can call it a self administered background check if you like but that doesn't define a background check. The form is not sent to the ATF. It is filed and retained by the dealer by law. The background check occurs when the dealer phones ATF with the personal info of the customer. ATF checks for a criminal record and then accepts or denies the sale. If one lies on the form as Hunter did, neither the dealer nor ATF have a reason to dispute how the customer answered since they don't know the person. ATF will approve the sale if there is no criminal record of a felony. The whole thing is silly frankly but that fits with much of what federal government does.

    If the customer becomes the subject of a gun violation investigation, ATF will contact the dealer for a copy of the form if they need it for an indictment. That is why the dealer is required to keep the form. The forms are all sent to ATF if the dealer ceases being a dealer. The form is never involved in the sale of a gun unless the customer makes a response on it that bans the sale. It isn't used for a background investigation.

    His point is that guns are burdened with volumes of laws already. Adding more laws won't help reduce gun related crimes. Criminals don't abide by laws as we all know. Adding more laws makes gun ownership fussier for people who abide by laws. The solution to gun related crime is not the inanimate gun. It is the criminal that misuses it. In mass shootings the criminal is almost always a sociopath. Control sociopathy and mass shootings will decline. Prosecute crimes and criminality will decline. It couldn't be more simple.

    drinking or doing drugs should not even be on the form.... just like cars, the crime is operating a gun while intoxicated

    the drug war has no business taking away people's rights

    Simple? How would we control that? Sociopaths are not often obvious. Usually, we don't detect it until someone has committed specific crimes, unless the sociopath is famous for some reason. What's the plan, in your opinion?

    Lock them up like we did in the old days. Mass shootings are a fairly recent phenomenon.

    So, are you an expert on identifying sociopaths? Or must we wait until they kill someone? That doesn't seem like much of a solution to me.

    And when you lie on the form, authorize the check, and fail it guess what? That's a crime you've committed.
    And the form is the direct evidence of that. The form, which authorizes the background check.
    Literally, the piece of evidence used for this charge IS the 4473 ffs.
    Please go talk to someone who knows less about the subject and will allow you to prattle on.

    The reality is that the majority of mass public shooters are individuals who would not be classified as either clinically or legally insane at the time of their crime.

    Unfortunately, in their search for a solution to the mass shooting epidemic, certain interested parties and groups in the U.S. have made scapegoats out of legislators, lobbyists, gun manufacturers, law enforcement authorities, the mental health field, schools, and even the media. With every accusation made, some interested party declares that one or more of the aforementioned groups are boogeymen and thus to blame for the mass shooting epidemic.

    In reality, most of the scapegoating arguments are myopic and self-serving for the interested party. That is not to say there are no truths to be found in the popular arguments, such as the blaming of assault rifles for the mass shooting problem. It is certainly true that assault rifles exacerbate the problem, but their existence and availability are not the cause of it.



    Your article pretty much destroys the 'mass shooting' narrative -- both the 'why' and the 'what we need to do' from the left.

    And my point is: You're demonstrably incorrect and telling faerie stories.
    You can't get the background check without authorizing it by filling and executing the 4473. Signing the 4473 is what allows the background check to proceed in the first place. If your check bounces, that's a crime and the BATFE is supposed to charge you for it. The main piece of evidence? Your 4473.

    They're supposed to investigate, and then see if charges are warranted -- your check can incorrectly result in a 'stop'.
