I would be interested to see how you came to the conclusion that the decision was done illegally, and to a certain degree states are allowed to decide on how they interpreted Roe vs Wade, hence why we have the Unborn Victims of Violence Act. It is also interesting to note that at the time of Roe vs Wade the SC was pretty evenly split on the political scale, with one moderate who, had all the others voted as per political policy, would have been the casting vote .. yet .. the court ruled 7-2 in favor, which can only show that at least 2 of the Republican judges voted in favor and against their political policy.
The way the constitution is set up is not as a true democracy, but as a republic, a true democracy would have population votes on all major issues, where as a republic is set up so that the elected representatives vote in respect of the populations wishes, it was done this way because the founding fathers did not believe the population had significant knowledge to vote without prejudice.
The constitution itself it set up to create a republic country and not a full democracy.
