    You are assuming that his intent was to kill. If that were true, he'd done something else

    who would you rather be on a subway with-Penny or the Mope who died?

    No, but I have said that this bloke is a trained killer and he attacked his victim from behind with a choke hold (maintained for SIX minutes) which may or may not have been the cause of death. Not, by far, a medal winning performance.

    I could handle the victim, I doubt I could handle a trained Marine killer like Penny especially if he prefers to act cowardly from behind me. No medal for him. He'll be lucky to escape prison. He ain't out of judicial water yet.

    The claim that Neely choked him for 6 minutes isn't supported by the prosecution's own witnesses who testified against this allegation. This seems to be a case of the prosecution leaking false statements to the press and then let them repeat it over and over again until people believe it is true.

    I'll let the Jury decide that. I don't know all the facts. All I know is that he attacked a numpty from behind and after he put a choke hold on him for 6 minutes, said numpty is dead.

    Who says I hate him? (Why do you toss up such an obvious strawman piece of garbage, like 'do you still beat your wife?')

    I say what he did is not not medal worthy.

    I 'favour' neither. I do assert that choking some numpty in a crowd who was mouthing off large from behind for six minutes until he expired is not medal worthy, especially while a Jury still has the matter under consideration.

    I never said she yelled those words, but it is clear that those words were being yelled at when you have the mob trying to break through the police barricades. Why else trying to go through a small window, was told to stop but didn't, and the police officer had no choice but to open fire.

    The judge screwed up. Either Penny will be acquitted or the court of appeals will reverse because the Trial Court screwed up big time

    The last I heard, it was a hung jury. The manslaughter charge was dismissed, and the negligent homicide charge was still on the table. But in the end, it will be up to the prosecution to retry the case or let it go if the jury is still hung with negligent homicide. NY Statute 35.13 governs self-defense and another statute governs the requirements for negligent homicide. I can see it both ways, but given the evidence of the case, and not the court of public opinion, the DA does have a strong circumstantial case. The issue is how the jury sees it.

    The chokehold was brief and put him to sleep. He then restrained him without pressure. That is perfectly acceptable. Doesn't matter what lies someone else says about this alleged 6 mins lol

    The people on the train are the only ones who have opinions that matter and they see him as a hero. 44 convictions and the bad guy is moving freely among people. In what world does that happen? The guy is 42 years old. The system failed the bad guy and the people who were unfortunate to run across his path.

    More time = more lawfare by stalling the "not guilty verdict", thus wasting the defendants money while the prosecution spends free money on a sham case.
    This is "consequences implied" to the jury if they don't vote right.

    the judge, by dismissing the top count violated his own charge-that the jury could ONLY consider the lesser charge if they ACQUITTED on the top charge. That alone is reversible error if the jury decides to convict on the lesser charge
