    There's no reason to disrespect their wish to be seen as females in most situations. Life is difficult enough for these folks in a cisgender world.

    Fine, respect them, but we are discussing whether trans women should be allowed to compete in sports at the university level against cis-women -- people born female (those used to be called "girls") and who never underwent sex reassignment surgery or hormones therapy.

    What is your position on that?

    No, but I would hope that sports officials at the NCAA spend (not "waste") time doing exactly that.

    Right. But I thought "trans" women drew a distinction between their sex (male) and their gender (female).

    Title 42 is health law and has nothing to do with Title IX. Not that you explicitly said otherwise.

    This seepage of gender identity into title IX occurred during the Obama administration. Title IX by its terms continues to prohibit "sex" discrimination, not gender identity discrimination.

    The question is whether congress will at some point amend title IX to include gender identity.

    There is also the possibility that the Supreme Court will one day interpret "sex" under Title IX to include gender identity, as it did under title VI in the Bostock case.
