    Question 3. If a business qualifies as an “essential business and operation” under the EO, should it ensure that its employees can travel to work?


    A. Employees may carry “travel papers” or a “safe passage letter” to indicate the employee works for an essential employer and/or needs to travel to maintain the minimum basic operations of the business, although Governor Pritzker has publicly stated that no such papers are necessary.


    Shutdown Activities

    Question 4. If a business was required to shut down pursuant to the EO, is anyone permitted to work on the premises?


    A. The EO permits “minimum necessary activities to maintain the value of the business’s inventory, preserve the condition of the business’s physical plant and equipment, ensure security, process payroll and employee benefits, or for related functions.” Only those essential personnel required to be present at the business to maintain these minimum basic operations should be allowed to work on-site. If work necessary to maintain basic operations can be done remotely, employers may want to encourage workers to perform such activities from home.


    Question 5. Are employers required to pay any expenses for employees who are now working from home due to the shutdown of a facility?


    A. Employers whose employees are working from home due to a shutdown may want to consider an emergency telecommuting policy. Keep in mind that state law requires employees who incur expenses to work from home to be reimbursed for these expenses. Specifically, the statute requires an employer to “reimburse an employee for all necessary expenditures or losses incurred by the employee within the employee’s scope of employment and directly related to services performed for the employer.” Necessary expenditures are defined as “all reasonable expenditures or losses required of the employee in the discharge of employment duties and that inure to the primary benefit of the employer.” Personal computers, mobile phones, and in-home Internet service will likely constitute necessary expenditures that need to be reimbursed at a reasonable amount.


    The statute also requires employees seeking reimbursement to “submit any necessary expenditure with appropriate supporting documentation within 30 calendar days after incurring the expense, except that an employer may provide additional time for submitting requests for reimbursement in a written expense reimbursement policy. Where supporting documentation is nonexistent, missing, or lost, the employee shall submit a signed statement regarding any such receipts.”


    An employee is not entitled to reimbursement when:


    • the employer has an established written expense reimbursement policy and the employee failed to comply with the policy; or
    • the employer did not authorize the employee to incur the necessary expenditure.
    Based on the first exception, employers may want to consider adopting a written expense reimbursement policy to better plan for potential employee reimbursement requests. Because the Illinois Wage Payment and Collection Act governs these requirements, there is an independent cause of action for individuals to seek enforcement in any court of competent jurisdiction.


    Question 6. How can employers track how much time employees working from home are working and the pay to which they are entitled?"

    It is not absurd. What is absurd is that the people who lobbied for National ID and wanted to get rid of undocumented foreigners now complain when we could use that law to test people for the virus and contain it. It is not absurd that people want to stand in the way of the fastest way to contain and control the virus and not demand that we test everybody and put them back to work. Oh, there is that faction that thinks we can somehow identify undocumented foreigners and another that thinks we can violate peoples Fourth Amendment Rights with endless background checks AND not figuring in the number of potentially employees that forfeit their Rights by doing drug tests to get a job, but balk at taking a needle prick to the finger so that they can return to that same job.

    OTOH (and this is kind of lawyerly of me to pontificate on both sides of a purely political issue) - I can't help but notice that the grocery stores are working at a break neck pace to eliminate cashiers and move toward a cashless society. Ditto for the fast food industry. If you want a global government, you start a global pandemic. When I started thinking about the fact that India has close to ... maybe a BILLION AND A HALF residents and much of India is impoverished and dirty, it's amazing that their death rate is less than that of the United States with its 330 million residents.

    Whether by accident or design the sheeple are getting easier to herd; more willing to just surrender their Rights and accept lockdowns that the government cannot enforce. Fact is, a county cop told me that he had no authority to enforce the governor's orders to shelter in place. He said only the state patrol had authority... all 480 available personnel for that job statewide. That's not enough manpower to police the city of Atlanta much less the state of Georgia.

    But, back to India. How come their impoverished communities are not dying in the millions like the people in New York are (if you look at the pandemic on a per capita scale) where they are packed into one place like a can of sardines? Then I empty my thoughts of a conspiracy and think that the most logical thing to do is use every available testing facility and get every American tested and move past this asap. The world is full of contradictions. The people who wanted a society that had the capability of testing the entire United States - and even want everyone to prove they are a citizen of the U.S. are the ones fighting using that same power to violate the Fourth Amendment to be tested for a virus... and with death being a possible side effect of the Corona virus, one might argue probable cause exists to test the people and get them back into their normal routines.

    But our air quality is getting better. If it goes long enough, we might see a significant dip in greenhouse gases, and thus a reprieve from global warming, if only for a moment.

    Then logic dictates that if global warming can show a significant dip in just three months then clearly it wasn't all that significant to begin with ;)

    Significant as in detectable. In most major cities there are photos showing a noticeable clearing of the air.

    That's exactly what somebody who refuses to read why it is not absurd would say.

    Fortunately most people do like to base their opinions on facts. Hope that's enough to compensate for most of the damage that those who don't are causing.
