You don't point something that looks like a gun at cops. It's really not complicated. Stop throwing around legalese like it makes you know what you're talking about, because you clearly don't.

ya know, I watched that video at least six times and I never once saw the kid threaten anyone not even the cop. They just rolled up and shot him. The kid didn't even time to drop the toy gun

I saw the video too. It was dark. The cop car driving up obscured the view. Bottom line, the little idiot was ordered to drop the pistol. He raised it instead and was given lead for his troubles.
Think of it as protective Darwinism. One less uneducated gang banging welfare bum to worry about.

Did you watch the video? At what point in the video did he point the gun at the cops?

Hmm. Maybe you're right. Looks like it was ruled a homicide after all.

Well, liberal who cried wolf.

TN Woman Points Gun at Police; Taken Into Custody Without Incident

http://www.dailykos.com/story/2014/...at-Police-Taken-Into-Custody-Without-Incident

I couldn't decide if this a story about a "gun fail" or about white privilege or a story about the police that would likely have had a much different ending had it taken place in a black (or Latino) neighborhood. The reality is that all of these things can be true. This is a story about a likely disturbed woman who had access to a firearm and went on a drive-by shooting spree.

Clouse did not recognize the driver, but the woman arrested for attempted murder, Julia Shields, 45, lived just up the street at 1504 Cloverdale Drive.
Police said Shields, blonde and wearing body armor, raced through the neighborhood, past well-manicured lawns and simple brick houses, firing multiple shots out her window at people and cars.

It's also a story that would likely have had a much different ending had it taken place in another part of town.
Shields sped away in her car and led officers on a chase down Highway 153 and Hixson Pike, still pointing her firearm at vehicles she passed.
Eventually, officers stopped and arrested Shields at Cloverdale Drive and Koblan Drive, near the spot where the shootings occurred and just blocks from her house. She pointed her firearm at an officer, but was taken into custody without incident or injury, the release stated.

I'm not a police officer and I'm sure that if this suspect had actually fired at the police, then they would have fired back. But, I do wonder a bit as to how/why a suspect who has fired at multiple people, houses, and cars, led the police on a chase, and aimed a gun at an officer, is taken into custody "without incident" while unarmed kids, kids playing with toys, and adults looking at toys in a discount store aren't afforded the same discretion and restraint

Do you have any evidence whatsoever that he pointed a gun at a cop in the first place? Or are you simply a full of (*)(*)(*)(*) rascist?

some cops are better at handling these situations then others, some do shoot first ask questions later.. so know that the odds are in their favor that a person will not shot a cop, that is rare, but is always a risk, in this case I am surprised the cop did not shoot

this is a picture of her

Yes he was. The threat doesn't have to be real. It only has to be believable. That's the law. Kids DO shoot people and kill them. Gang members 9 and up have killed and have done it with guns. This kid brought it on himself.
Like I said earlier, there was a similar shooting at a Seminole County high school near Orlando. Deputies were called to a middle class high school. A teenage boy was waving a toy gun around. He pointed it at the cops and they returned fire. He was killed. And the ONLY reason this story never made the papers was because HE WAS WHITE AND THE COPS WERE WHITE. It was considered a justified shoot because there was a perceived threat.
The ONLY reason you liberals are even bothering with this story is because of the race of the little brat who was waving the gun around. Had that brat been white or Asian, you wouldn't have given a sht.
This isn't about law or threats. It's about race.

exactly, I have been attacked by both sides for saying as much, the cop can have a justified shoot even if there is NO REAL threat, but they BELIEVE there is a threat

the example of a toy gun is a perfect example where the cop is wrong, there is no threat, but the cop is still justified to shoot

some people believe the cop is always correct and the threat is always real if a cop shoots someone, that is not always the case

all it means is a cop feared for their life, doesn't mean the treat was real, just that it was perceived by the officer as a threat

Here's a link to the video of the murder...

At what point in that video does Tamir Rice threaten the pig? Feel free to post a screenshot of him threatening the pig.

Of course you won't post it because it does not exist.

Here's the (*)(*)(*)(*)ing law...

THE RIGHT OF THE PEOPLE TO KEEP AND BEAR ARMS SHALL NOT BE INFRINGED. -- 2nd Amendment, US Constitution.

Yet anti-constitutionalists such as yourself always insist that the state can take the life of anyone who has any sort of arms anytime they want. Doesn't matter if it's a BB gun, a pair of nail clippers or whatever.

So, by your logic, it is perfectly legal for a pig to hang out at Toys-R-Us and blow aweay every child he sees pick up a toy gun, so long as he "feels threatened" for some ridiculous reason.

That's pathetic.

this is one of the reasons I feel you should not have to have a license to conceal a gun

it's illegal to conceal a gun, it's legal to have it out in the open only

having it out in the open makes others think your a threat..... why would the law what to make gun owners look like a threat?

as for the video, could not tell much from it, it all happened so quick I am not sure even the cops had time to process the situation properly

When I was a kid, my brothers, some neighborhood friends and I would take our BB guns out to a nearby park all the time. We'd choose sides and have BB gun wars. Usually it would be a 5 pump limit. That way it might sting a bit when you get hit but most likely it wouldn't break skin or go through sunglasses.

By the logic of some people here they should have sent a SWAT team to slaughter us.

legal to shot a kid showing a gun.. yes

is it right.... no

there is a difference, legal is not always right and illegal is not always wrong

as for the example, if the officer says he feared for his life, how can we prove the cop is lying? we can prove the threat wasn't real, but we can't prove the cop is lying

now if he was hanging out by the toy guns and knew they were toys, then we could prove he was lying, though some cop defenders might still defend the officers actions

In other words, you cannot say at exactly what point in the video that Tamir Rice threatened the cop.

In the video a cop car flew up into the park and a cop got out and murdered him in cold blood.

See those pieces of wood sticking out of the ground? Those are called "bollards". They are structures which are installed there to prevent large vehicles such as police cars from driving into the park. The pig evidently avioded them to get into the park, then the passenger pig immediately jumped out and murdered a little kid for no apparent reason.

If that is truly the case, then obviously we need to change the laws.
BTW, if its legal to shoot a kid with a gun out, does that also mean its legal to shoot an adult who has one?
(silly question, I know, but then this whole it's legal for cops to shoot people just for holding a gun thing is pretty silly too)

For this we need to establish clearer guidelines about what constitutes "reasonable" belief that there is a threat,
or concoct some methodology of determining it. We also need to establish what constitutes criminal negligence, because it is possible for one to legitimately fear for their life while also taking or having taken unnecessary/unjustified actions which lead to increased risk for themselves and or others.

Of course, traditional trial juries in which both the defense and prosecution make their case can be used for this, but for those to work cases would actually have to go to them.

BTW, in this case it actually appears that the cops may have been lying about the events themselves,
about what actually happened based on their statements compared with what you can actually see in the video,
not to even mention whether they actually feared for their lives or were justified in their actions.

To deal with that issue, we ought to be making body cameras standard issue in every police department.

The US Constitution does not say that the people have the right to keep and bear arms only if those arms cannont be construed by idiot pigs as being "concealed". That is not in the US Constitution.

The US Constitution says that the right of the people to keep and bear arms shall not be infringed. It also says that a person shall not be denied the right to life without due process of law. Tamir Rice's civil rights were violated no matter what way you look at it.

Even if Mr. Rice had a firearm (which he obviously didn't), that is not illegal in the first place.

The pigs just rolled up, driving very recklessly, and shot a little kid who no reasonable person would have considered a threat.

Many people would probably consider me to be one of the most racist people on this forum, and even I can see that this was a clear violation of Tamir (what parent calls their baby "Tamir"?) Rice's civil rights. This is the type of thing that could make the race war in the US. a reality.

Justice must be served for the sake of civil rights, 2nd amendment rights, and for the good of the nation, IMO.

The murderer needs to be prosecuted.

How much good can that actually do if even when cops clearly murder someone on video, they are not even indicted anyways?

Would certainly be better than just having the word of the cops themselves to go by.
Its not just one change that needs to be made to start to fix this, body cams are step in the right direction don't you think?
