The thread title came from the story, not from the original poster of the story.

    Of course it was.
There a very good chance the prosecutor will agree.

They arrested him for DUI, and it was perfectly reasonable of them to do so.

    As a fleeing felon.
    Good shoot.

That's quite a comparison. He offered to walk home before the sobriety test. At that point, he'd been asleep behind the wheel. If you would like to compare that to rape, carry on.

My eyes saw a man shot in the back while running away from police. The taser has nothing to do with it and the cops know it. Second degree murder.

Your eyes saw a fleeing felon, armed and intoxicated, and thus an immediate danger to the people in the vicinity.
    Good shoot.

He was a fleeing felon armed with a spent taser. You don't shoot people in the back for being intoxicated. Second degree murder.

They didn't. They shot him because he was a fleeing felon.
Note that "fleeing felon" is a legal, as well as a descriptive term.
    Good shoot.

How in the world can anyone defend what the police did in this case. It appears that the trigger man has quite a history of letting the bullets fly during his 7 year career on the force.

What point did I miss or avoid? You are comparing a rape to someone sleeping in their car. Because he was "slightly" inebriated (quote from the prosecutor). If you see that as a valid comparison, good for you. I don't.

Are you aware that being drunk in public is illegal?
Are you aware that he could have come back for his car and killed a family of 6 and 4 small children?

They did the right thing. It's about protecting society...not one persons right to drink and drive

    He RESISTED ARREST ON CAMERA.

How they charged him with murder is the million dollar question

Shooting a guy in the back while he is running away is a cowardly act. Exactly how is Brooks a threat to the two cops if he is running away?

So you're okay with cops acting has judge, jury and executioners? Shooting anyone in the back is a cowardly act. Brooks was no threat to society once the cops removed him from his car. Stupid cop for letting Brooks take his laser.

NO. And I did NOT SAY THAT so just stop right there.

I'm OK with cops dealing with violent criminals who believe they are above the law

You are wrong. For all you know Brooks may have gone back to his car and driven drunk again, killing a family. Are you even aware he was .108 and the legal limit is .08 ?

Brooks was violent, attacked the cops and was a threat to society.

Not if the car was impounded. Brooks didn't run to the cops in a violent manner. He was running away. So exactly how threatening was Brooks to the cops and society?

So, because he is intelligent, well spoken, law abiding, he's an Uncle Tom? Are those qualities only reserved for white folks? How very racist of you....

Uh, you missed the entire part of him assaulting cops, stealing a Police weapon
The cops lives were in immediate danger. he had their Tazer. he could have tazed them and taken their gun and shot them dead.

ALL HE HAD TO DO was do as the cops told him.

He would be alive today no problem.

You think the DA knows a little more about the law then you?

Police officers "can't fire a gun" at someone running away, DA says

Atlanta police officers are prohibited from firing a gun at someone who is running away, Fulton County District Attorney Paul Howard said during a news conference today.

Howard referenced the city's standard operating procedure (SOP), which also prohibits officers from firing a taser at someone running away, he said.
