    Supreme Court has voted to overturn abortion rights, draft opinion shows

    "We hold that Roe and Casey must be overruled," Justice Alito writes in an initial majority draft circulated inside the court.


    The Supreme Court has voted to strike down the landmark
    Roe v. Wade decision, according to an initial draft majority opinion written by Justice Samuel Alito circulated inside the court and obtained by POLITICO.

    The draft opinion is a full-throated, unflinching repudiation of the 1973 decision which guaranteed federal constitutional protections of abortion rights and a subsequent 1992 decision – Planned Parenthood v. Casey – that largely maintained the right. “Roe was egregiously wrong from the start,” Alito writes.


    “We hold that Roe and Casey must be overruled,” he writes in the document, labeled as the “Opinion of the Court.” “It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.”

    This is a draft from February. It is unusual for such leaks from the court. Only Politico reporting.

    This sends it back to the courts. The pro-Abortion side will now have to get legislation passed in each state. This is not the end of abortion, just sends back to the states.

    I've never seen a previous draft opinion leaked before to the press like this.

    So either someone is desperately trying to cause an uproar by leaking this or someone is making stuff up.

    Either way what do we call all the people who will storm the national capital and the Supreme Court build and will begin burning and rioting in the streets across cities?

    Will we arrest and hold for trial all these insurrectionists? Will they merely wait for the next election and vote peaceably?

    I think the ruling will send it to the states as a state matter. Do you agree the voters should decide and not a court?

    I suspect Republicans will still win the House, at least. Most people are more worried about Biden's stagflation.

    No, it doesn't guarantee that at all. You might hope that's the case, but Biden/dems have dug too deep a hole on other issues. It will be ugly in November for the dems

    Yes it is a VERY serious matter that this was leaked and the consensus I am seeing it was done by someone who wants to rile up public opinion to try and influence the court. The person should be found out and immediately disbarred. The legal experts I have heard so far say they have not found a federal statute that would apply but still looking. I bet Roberts is LIVIED and will be bringing EVERYONE involved into his office to find out who did it.

    I think this is unprecedented. I don't recall there ever being a leak of a SC decision like this. But on the other hand, for some, R v W is the most important court decision in US history, so I'm sure some activists could fool themselves into thinking they're doing the right thing.

    It would have to have been not just any activist, but one with access to the draft opinion. They should take a long, hard look at the liberal justices and their law clerks.

    This news is laughable. It is like far right extremists shooting themselves in the foot in full public view. It is well-established fact that the vast majority of Americans want Roe V. Wade sustained. This is kind of like a death-knell for all the bizarre Trumpian dinosaurs/rubes in USA. It won't take long for Congress to muster support for, and thence enact, a Federal law affirming every woman's absolute access to abortion nationwide; and be signed by our illustrious wonderful President Biden!
