In the first 30 minutes of the trial this morning, Judge Beryl Howell went over how they would ask the jury to determine how “reasonably foreseeable” it would have been for Giuliani’s false claims against Freeman and Moss to be republished and circulated.

Howell said they could all confer on the wording of that to the jury, or else they would just need to trust her to come up with the wording. The plaintiff’s lawyer, Michael Gottlieb, said they’d confer with Giuliani’s lawyer, Joseph Sibley.

Gottlieb also indicated that Freeman would take the stand later, after the Atlanta poll observer and Humphreys.

Giuliani attacked Moss and Freeman in a video broadcast live on social media Tuesday night after the conclusion of the second day of the trial.

"They’re seeking $40 million. Oh, yeah. They’re seeking $40 million for the damage that I allegedly did to them. One of them did testify that she has no money. They do have an endless number of lawyers in the courtroom, however, for people that don’t have any money," Giuliani said in the video stream shared to his X account.

Giuliani continued to list off how many lawyers the plaintiffs had at their table in the courtroom, adding that the opposition's team had entered a large amount of discovery. "That's a lot of lawyers to be paying," he said'

Rudy knows damn well that after seeing what Trump/him and their thugs were doing to Freeman/Moss their moral compasses moved to pro-bono.
So sad that NO lawyer is stepping up to defend Giuliani on principles. lol

Freeman calls Trump's call to Georgia officials 'mean' and 'evil'

Then-President Donald Trump invoked Ruby Freeman's name more than a dozen times in his infamous phone call to Georgia officials on Jan. 2, 2021, when Trump implored Secretary of State Brad Raffensperger to "find" enough votes to win him the state.

After an audio recording of the call was later made public, Freeman described hearing her name come out of the mouth of the "most powerful person on Earth," as her attorney characterized Trump.

"Where's Ruby?" Trump could be heard asking Raffensperger, referring to an expression that was then trending online.

"I just felt like, 'Really?'" Freeman testified. "The president, talking about me? Me? How mean, how evil."

"I just was devastated," she said. "It made me feel like, you don't care that I'm a real person."

Jury shown lynching threats that 'terrorized' Freeman
Jurors were shown a smattering of the racially charged threats Ruby Freeman received after video of her and her daughter counting ballots at State Farm Arena on election night circulated online.

The emails flooded her inbox on the night of Dec. 3, 2020, with several invoking lynching and references to the Ku Klux Klan.

One email, from an account called Grand Wizard with the email name "kkk" said, "Safest place for you right now is in prison. Or you will swing from the trees."

Another suggested the government hang her and her daughter from the "Capitol dome," saying, "I pray that I will be sitting close enough to hear your necks snap!"

Several of the messages accused her of being a traitor or "SCUM."

"I received so many on my phone that at one point my phone crashed," Freeman testified. "I felt horrible. I felt terrorized. I was scared … people are coming to kill me. They have my address, they have my phone number, they know my name."

Freeman testified that two days later, on Dec. 5, 2020, people began to show up at her house and she was forced to call the authorities.

While on the phone with police, Freeman said people were "banging" on her door.

"Not only am I getting phone calls and emails and stuff, now you're actually coming to the house," Freeman testified. "I was scared."

 

Probably because the Georgia phone call was not an official public utterance of Trump. It's certainly good (great!) evidence of post election attempted fraud, but I don't think it can be used in a defamation situation. Is there any report of Mango defaming them in a public setting?

Rudy did it publicly in various ways... including his own podcast....

 

Trump played part of the arena video at his rally in December 2020 the same month his campaign unleashed hell on Freeman and Moss.
They have excellent lawyers from different firms/law-schools, I wish we knew if it was the legality to not sue him or they just knew it wouldn't be worth the time and effort or were the ladies too fearful of going after him, which would actually make a lot of sense considering what they experienced?

'After Freeman's emotional testimony, Giuliani’s lawyer declined to cross-examine her. The plaintiffs have now rested their case, and court has been adjourned for the day.

The jury has been instructed to report tomorrow at 10 a.m. to give the parties time to discuss legal issues before the defense puts on their case.

Giuliani is expected to take the stand tomorrow as the only defense witness.'

'Michael Gottlieb, one of the lawyers representing Ruby Freeman and Shaye Moss, has just completed his closing argument.

In his final remarks, he asked the jury to send a message to other powerful people with whatever punitive damages it chose to levy against Rudy Giuliani.

“The message is, ‘Don’t do it,’” he said. “He has no right to offer defenseless civil servants up to a virtual mob in order to overturn an election.”

Gottlieb asked the jury to award Freeman and Moss $24m each in damages to repair the damage to their reputation from 16 defamatory statements Giuliani made about them.

He asked the jury to use their discretion to determine punitive damages as well as much how much to award for intentional infliction of emotional distress.

“Ruby Giuliani used his power to scapegoat Ruby Freeman and Shaye Moss,” he said. “He didn’t see them as human beings.”

Joe Sibley, Giuliani’s lawyer, is about to begin his closing statement.'
