    The Colorado Supreme Court on Tuesday declared former President Donald Trump ineligible for the White House under the U.S. Constitution's insurrection clause and removed him from the state's presidential primary ballot, setting up a likely showdown in the nation's highest court to decide whether the front-runner for the GOP nomination can remain in the race.

    The decision from a court whose justices were all appointed by Democratic governors marks the first time in history that Section 3 of the 14th Amendment has been used to disqualify a presidential candidate.

    Colorado's highest court overturned a ruling from a district court judge who found that Trump incited an insurrection for his role in the Jan. 6, 2021, attack on the Capitol, but said he could not be barred from the ballot because it was unclear that the provision was intended to cover the presidency.

    The court stayed its decision until Jan. 4, or until the U.S. Supreme Court rules on the case.

    Imagine if Trump is disqualified in Arizona, Georgia and Pennsylvania.....

    I'm not sure.

    The Constitution clearly states that you can't hold a government position if you've given comfort to insurectionists.

    Will SCOTUS conclude that being President is not a government position?

    Nothing is less certain.

    This will win the Democrat fascist part the election which is why they are excited about it. This will create a lot of confusion in the republican party on who to or can be voted for in each state.

    A candidate does not need to win every State, and never does. In 2016 Trump lost 15 States, including Colorado and Texas and still won the nomination.

    the democrats keep poking at the USSC. they should leave well enough alone-the Supreme Court's decision in Dobbs was the biggest gift a court has given a political party since the USSC prevented Gore from stealing Florida.

    It's not fascism, but it's probably not up to the Supreme Court of Colorado to decide whether there was an insurrection or not.
